Welcome to Albemarle Telecom. These Terms of Use (“Terms”) govern your access to and use of the services, websites, and equipment provided by Albemarle Telecom (“the Company,” “we,” “us,” or “our”) in the service areas of Northeastern North Carolina and Southeastern Virginia.

By activating, using, or paying for our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

Scope of Service

Albemarle Telecom provides residential and business telecommunications services, including but not limited to High-Speed Internet, Voice over IP (VoIP), and Fiber-to-the-Home (FTTH).

Service Area: Our primary service footprint includes the Albemarle Sound region of North Carolina and the Hampton Roads/Tidewater area of Virginia.

Eligibility: You must be at least 18 years old and reside within our authorized service area to establish an account.

Acceptable Use

You agree to use our services only for lawful purposes. Prohibited activities include:

  • Network Interference: Any action that harms or disrupts our network or other users' ability to access services.

  • Illegal Content: Hosting or transmitting child sexual abuse material (CSAM), infringing on intellectual property, or engaging in fraudulent schemes.

  • Resale: You may not resell Albemarle Telecom services to third parties without a specific wholesale agreement.

  • Compliance with School Laws (NC/VA): In accordance with North Carolina Session Law 2025-38, users are advised that school-issued devices or networks used via Albemarle Telecom services may be subject to state-mandated social media restrictions and "Away for the Day" mobile device policies.

VIRGINIA & NORTH CAROLINA CONSUMER PROTECTIONS
Virginia Telephone Privacy Protection Act (VTPPA)

Per the 2026 amendments to the VTPPA (Va. Code § 59.1-510), Albemarle Telecom strictly adheres to telemarketing and solicitation regulations:

  • Opt-Out Rights: You may opt out of marketing communications at any time. For SMS/Text marketing, replying "STOP" or "UNSUBSCRIBE" constitutes a legal opt-out that we will honor for a minimum of 10 years.

  • Solicitation Hours: We will only contact you for non-emergency solicitation between 8:00 AM and 9:00 PM local time.

North Carolina Privacy Rights

We comply with all North Carolina consumer data protections, ensuring transparency in how we collect and utilize subscriber metadata.

Equipment & Installation
  • Ownership: Unless purchased outright, all equipment (modems, routers, ONTs) remains the property of Albemarle Telecom.

  • Access: You grant Albemarle Telecom employees or authorized contractors access to your premises during reasonable hours for installation, repair, or retrieval of equipment.

  • Damage: You are responsible for the replacement cost of any Company equipment lost, stolen, or damaged while in your possession.

Billing & Payments
  • Invoicing: Services are billed monthly in advance.

  • Late Fees: Payments not received by the "Due Date" are subject to a late fee as permitted by North Carolina and Virginia state law.

  • Taxes and Surcharges: Your bill will include applicable federal, state, and local taxes, as well as regulatory fees such as the Federal Universal Service Fund (USF) and state E-911 charges.

Limitation of Liability

IMPORTANT: ALBEMARLE TELECOM PROVIDES SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE.

To the maximum extent permitted by law:

  • We are not liable for damages resulting from service interruptions, including those caused by "Acts of God" (e.g., hurricanes, coastal flooding common to the Albemarle/Hampton Roads region).

  • Our total liability for any claim shall not exceed the amount paid by you for the service during the three (3) months preceding the claim.

Dispute Resolutions & Arbitration

Any dispute arising from these Terms will be resolved through binding arbitration rather than in court, except for small claims court matters.

  • Governing Law: The laws of the state in which your service is installed (North Carolina or Virginia) shall govern these Terms.

  • Venue: Arbitration shall take place in Pasquotank County, NC, or the City of Norfolk, VA, depending on your service location.
